Welcome to Run with Max (the "App"), an AI-powered running coach service operated by Jullian Oliver, an individual entrepreneur based in Paris, France. These Terms of Service ("Terms") govern your use of the App and all related services.
By downloading, installing, or using the App, you acknowledge that you have read, understood, and agreed to these Terms. If you do not agree, do not use the App.
Run with Max provides:
Some features require an active subscription (see section 4).
You must be at least 13 years old (16 in the European Union) to create an account. You are responsible for keeping your credentials confidential and for all activity under your account. You can delete your account at any time from the "Profile" tab — personal data is permanently erased within 30 days.
You agree not to: (a) use the App for unlawful purposes; (b) falsify run data or impersonate others; (c) reverse-engineer, scrape, or attempt to disrupt the service; (d) resell or sublicense the App; (e) use the App to train third-party AI models or harvest data; (f) transmit offensive, defamatory, or rights-infringing content. Violations may result in immediate suspension or termination without notice or refund.
Run with Max offers monthly, annual, and "Founder" (preferential annual) subscription plans. Prices and free-trial details are shown in the App at purchase.
All subscriptions renew automatically at the end of each period at the then-current rate unless canceled at least 24 hours before the period ends. Payment is processed by the App Store (iOS) or Google Play (Android).
If a free trial is offered, it is valid once per user per plan. If not canceled before the trial ends, the paid subscription starts automatically.
You can manage or cancel anytime from your platform's subscription settings (iOS: Settings → [your name] → Subscriptions / Android: Play Store → Subscriptions). Cancellation takes effect at the end of the current period; premium features remain available until then.
Refund requests are handled exclusively by the App Store or Google Play under their respective policies. We cannot issue direct refunds. In the EU, the 14-day right of withdrawal for digital services is waived as soon as you start using the App.

Run with Max is a consumer coaching tool. It is not a medical device and not a substitute for professional medical advice.
Before starting or resuming physical activity, especially running, you must:
AI coach recommendations (target pace, durations, training load) are general suggestions based on the data you provide. They do not account for your specific medical conditions, medications, or daily state. You are solely responsible for deciding whether to follow these recommendations and for adapting them to your actual physical condition.
Use during pregnancy, post-injury rehab, or by minors requires prior medical professional approval.
The App, its design, text, synthetic voices, logos, the characters Max and Dash, and all AI-generated content presented in the App are the exclusive property of Run with Max or its licensors. No license is granted beyond the personal, non-transferable right to use the App for your private use. Your personal data (GPS tracks, statistics, content you upload) remains yours; by uploading it, you grant us a non-exclusive limited license to process it for the purpose of providing the service (see Privacy Policy).
Processing of your personal data is described in our Privacy Policy, which is an integral part of these Terms.
To the maximum extent permitted by law, Run with Max shall not be liable for: (a) injuries or health issues arising during or after use of the App (see section 5); (b) service interruptions caused by factors beyond our control (network outages, unavailability of third-party services); (c) data loss resulting from misuse, technical incident, or exercise of your deletion right; (d) indirect, immaterial, or consequential damages. Our total liability, in the event of proven breach on our part, is capped at the amount you paid for your subscription during the 12 preceding months.
We may modify these Terms at any time. For material changes (price changes, refund modifications, broadened data use, etc.), we will notify you via the App or email at least 30 days before they take effect. Continued use after that date constitutes acceptance. If you do not accept the changes, you must stop using the App and may delete your account at no cost.
We may suspend or terminate your account for clear Terms violations, fraudulent use, or behavior that harms the service or other users. In case of unjustified termination by us, we will refund the unused portion of your current subscription.
These Terms are governed by French law. Any dispute regarding their interpretation or performance will first be subject to amicable mediation, and, failing agreement, to the competent courts of Paris, subject to mandatory consumer protection rules applicable in other EU member states.
